Music has been a problem for <em>Alan Wake<\/em> before: Remedy had to pull the entire game off Steam, Xbox Games Store, and other platforms from May 2017 to October 2018 as the licenses were renegotiated. And it\u2019s not only a Remedy problem. It seemingly happens over and over again: <a href=\"https:\/\/www.polygon.com\/2024\/3\/20\/24105739\/alpha-protocol-2024-gog-drm-free-pc\">Sega and Obsidian Entertainment\u2019s <em>Alpha Protocol<\/em><\/a>, <a href=\"https:\/\/www.polygon.com\/2012\/11\/16\/3652910\/grand-theft-auto-vice-city-pulled-from-digital-pc-stores-due-to\">Rockstar Games\u2019 <em>Grand Theft Auto: Vice City<\/em><\/a> (<a href=\"https:\/\/www.theverge.com\/2012\/8\/1\/3212853\/grand-theft-auto-3-playstation-3-release-delayed\"><em>Grand Theft Auto 3<\/em>\u2019s PlayStation 3 launch was delayed<\/a>, too, over music clearance), <a href=\"https:\/\/www.polygon.com\/24140123\/what-happens-game-gets-delisted-spec-ops-the-line-adult-swim\">2K Games\u2019 <em>Spec Ops: The Line<\/em><\/a>, <a href=\"https:\/\/www.videogameschronicle.com\/news\/sony-claims-it-delisted-the-kotor-remake-trailer-due-to-music-license-expiring\/\">Sony Interactive Entertainment\u2019s upcoming <em>Star Wars: Knights of the Old Republic<\/em><\/a>, <a href=\"https:\/\/www.pcgamer.com\/tony-hawk-pro-skater-hd-will-be-removed-from-steam-next-week\/\">Activision\u2019s <em>Tony Hawk Pro Skater HD<\/em><\/a>, and plenty more have all had music licensing issues.<\/p>\n<p class=\"has-text-align-none\">People who are plugged into the video game industry hear about games being pulled from sale for these reasons all the time \u2014 something that will likely continue into the future. But what about other sorts of media On Polygon\u2019s <em>Alan Wake<\/em> news story, commenter VeronicaTriumphant asked a poignant question: \u201cWhy does this keep happening to games but it never seems to happen to movies?\u201d<\/p>\n<p class=\"has-text-align-none\">The answer there is complicated, and it\u2019s not the same for all movies, TV shows, or video games. Broadly speaking, however, it <em>does<\/em> happen to other forms of media. Jeffrey Cadwell, intellectual property attorney with law firm Dorsey &amp; Whitney, told Polygon that it\u2019s more common with older TV shows that hadn\u2019t considered licensing agreements for, say, streaming platforms like Netflix, which didn\u2019t exist when the shows were created.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube\">\n<div class=\"wp-block-embed__wrapper\">\n<div>\n<div><iframe title=\"Dawson&#039;s Creek Intro\" src=\"https:\/\/www.youtube.com\/embed\/izpNuTxGIrM?rel=0\" allowfullscreen allow=\"accelerometer; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share;\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<\/figure>\n<p class=\"has-text-align-none\">\u201cFor example, I know <em>Bosom Buddies<\/em> (the old Tom Hanks show) originally had a song by Billy Joel as the theme, but on DVD and now in syndication, it uses a separate theme,\u201d Cadwell said. \u201cBringing it more current, same issue with <em>Dawson\u2019s Creek<\/em>. The key when negotiating music licenses is to try to obtain all rights in perpetuity, so you do not have to go back in the future regarding format changes or reuse fees.\u201d<\/p>\n<p class=\"has-text-align-none\"><a href=\"https:\/\/www.vox.com\/2014\/11\/3\/7145231\/shows-not-on-dvd-music-rights-wonder-years-wkrp\" target=\"_blank\" rel=\"noreferrer noopener\">A Vox report from 2015<\/a>\u00a0said most modern TV shows now negotiate for \u201call possible uses of the song \u2014 initial broadcast, reruns, syndication, DVDs, international, and online streaming.\u201d That\u2019s why we don\u2019t see too many problems with shows created after the rise in popularity of streaming platforms.\u00a0<\/p>\n<p class=\"has-text-align-none\">Usually, producers for these shows will replace the music if needed,\u00a0<a href=\"https:\/\/www.nytimes.com\/2021\/04\/21\/arts\/television\/tv-soundtracks-dawsons-creek-freaks-and-geeks.html\" target=\"_blank\" rel=\"noreferrer noopener\">like in the case of\u00a0<em>Dawson\u2019s Creek<\/em><\/a>\u00a0\u2014 the iconic theme song, Paula Cole\u2019s \u201cI Don\u2019t Want to Wait,\u201d was replaced on streaming services with Jann Arden\u2019s \u201cRun Like Mad\u201d due to licensing issues. But that example itself is also a lesson in how complicated this whole thing can be: Arden\u2019s \u201cRun Like Mad\u201d was actually written for\u00a0<em>Dawson\u2019s Creek<\/em>\u00a0and the producers\u2019 original pick for the show\u2019s theme,\u00a0<a href=\"https:\/\/www.huffingtonpost.co.uk\/entry\/dawsons-creek-theme-song-netflix_n_1683506\" target=\"_blank\" rel=\"noreferrer noopener\">according to the Huffington Post<\/a>. Warner Bros. executives ended up changing their minds later, adding in \u201cI Don\u2019t Want to Wait\u201d as the theme song when the show debuted. The deal had to be renegotiated some years later, which is when\u00a0<em>Dawson\u2019s Creek<\/em>\u00a0lost \u201cI Don\u2019t Want to Wait.\u201d Instead of paying more money to Cole, they put Arden\u2019s song back in. When\u00a0<em>Dawson\u2019s Creek<\/em>\u00a0hit Netflix in 2020,\u00a0<a href=\"https:\/\/www.billboard.com\/pro\/paula-cole-dawsons-creek-theme-re-recorded\/\" target=\"_blank\" rel=\"noreferrer noopener\">fans revolted over the removal of the iconic \u201cI Don\u2019t Want to Wait,\u201d Billboard wrote in 2021<\/a>. In 2021,\u00a0<em>Dawson\u2019s Creek<\/em>\u00a0producers made a new deal with Cole; she re-recorded the song so it\u2019s licensed through her and a re-recorded master, not Warner Records. And so, the song returned.<\/p>\n<p class=\"has-text-align-none\">Movies are perceived to have a longer shelf life than video games, or at least they were in the past. Movie producers were more likely to get a license in perpetuity for that reason. Like in TV shows and movies, the video games that do get delisted for music licensing issues are often older ones that publishers didn\u2019t expect demand decades later. Instead of a perpetual license, video games are often issued \u201ca more limited license,\u201d Schacht said, that requires the maker to \u201cto come back to renegotiate \u2013 and pay \u2013 for additional rights when they need them.\u201d<\/p>\n<p class=\"has-text-align-none\">If publishers and studios can\u2019t \u2014 or don\u2019t want to \u2014 renegotiate, they\u2019ve got to pull their game, or patch out the music. \u201cThe infringer could be on the hook for a lot of money and be unable to use the music\u201d if they keep using music with expired licenses, Schact said.<\/p>\n<p class=\"has-text-align-none\">If you\u2019re looking for the <em>TL;DR<\/em>, here it is: Movies and TV shows <em>do<\/em> have similar licensing issues as video games, but it usually impacts older shows that didn\u2019t secure licenses for home distribution or streaming. You may not hear about it as often, because shows come and go from streaming services all the time.
