Hazelight Studios, the team\u00a0behind A Way Out<\/a> and this year\u2019s It Takes Two<\/a>, has abandoned the trademark behind It Takes Two after Take-Two Interactive filed a trademark claim against it, it\u2019s been revealed.\u00a0<\/p>\n

This news comes by way of Eurogamer<\/a><\/em>, which reports that Hazelight has indeed abandoned its trademark for \u201cIt Takes Two,\u201d but remains hopeful as a studio that a resolution will be reached. The publication\u2019s report indicates that Take-Two filed a trademark claim against Hazelight shortly after It Takes Two was released. Records show that Hazelight then abandoned ownership of the name.\u00a0<\/p>\n<\/p>\n

Eurogamer<\/em> reached out to Hazelight for comment, but it was told that the studio \u201ccannot comment on ongoing disputes,\u201d but that the team is \u201chopeful it will be resolved.\u201d As noted in the report, Hazelight did not dispute that it was forced to abandon its trademark of the name \u201cIt Takes Two\u201d due to Take-Two\u2019s claim, which can be viewed via this notice of abandonment from the U.S. Patent Office<\/a>.<\/p>\n

Despite speculation that this trademark claim might result in Hazelight having to change the name of its latest game, industry analysts believe that not to be the case.\u00a0<\/p>\n

\u201cThe trademark conflict means that Hazelight can\u2019t protect the name, not that they will be forced to change it,\u201d F-Squared consultancy founder and industry analyst Mike Futter<\/a>\u00a0wrote on Twitter. \u201cThey could change it if they want to protect the name, but honestly, it\u2019s probably not worth it to them to do that.\u201d\u00a0<\/p>\n

Futter continued, citing that Take-Two isn\u2019t saying Hazelight is infringing, but rather that Take-Two doesn\u2019t want Hazelight to be able to protect \u201cIt Takes Two.\u201d He said this could come into play in a theoretical situation where Take-Two might want to create a company motto that\u2019s \u201cIt\u2019s Take-Two,\u201d which Hazelight might have been able to stop as a result of its attempted trademark of \u201cIt Takes Two.\u201d\u00a0<\/p>\n

Lawyer Richard Hoeg<\/a>, who often analyzes industry news through a professional lawyer lens\u00a0on Virtual Legality, said on Twitter that \u201cThe \u2018It Takes Two Question\u2019 isn\u2019t nearly as bad as the sheer volume of extensions and challenges that Take Two uses to extract concessions from applicants.\u201d<\/p>\n

He added that if you look at the Trial and Appeals Board, you can see that Take-Two has filed extension requests for at least 25 challenges in the last three months \u2013 he said other game companies take six to seven years to reach that many challenges.\u00a0<\/p>\n

\u201cTake Two is being very, very aggressive,\u201d Hoeg said. \u201cIt Takes Two by comparison, isn\u2019t a company name, and it\u2019s of limited use in any event due to the sheer number of goods and services that already use the phrase. I would suspect they simply wind up going untrademarked and relying on copyright.\u201d\u00a0<\/p>\n

Hoeg\u2019s Twitter thread ended with him saying that his read on Take-Two is that it challenges almost anything it can find using one of its words a la \u201cTwo.\u201d\u00a0<\/p>\n
