Whether it&#8217;s effective is another story, but this is only part of the Act&#8217;s rollout. There have been months of risk assessments with UK regulator, Ofcom, trying to decide if certain websites fit into certain categories, ranging from <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.ofcom.org.uk\/online-safety\/illegal-and-harmful-content\/additional-duties-for-categorised-online-services\" target=\"_blank\">Category 1, 2A and 2B<\/a>, where Category 1 applies the strictest rules on a site or service.<\/p>\n<p>So, here&#8217;s the kicker: Wikipedia, based on its size and reliance on user-generated content is likely a Category 1. Wikipedia doesn&#8217;t want to be a Category 1. Wikipedia took its challenge to the UK&#8217;s High Court of Justice. Today, <a data-analytics-id=\"inline-link\" href=\"https:\/\/wikimediafoundation.org\/news\/2025\/08\/11\/wikimedia-foundation-challenges-uk-online-safety-act-regulations\/\" target=\"_blank\">Wikipedia lost that challenge<\/a>.<\/p>\n<p>Before you start scribbling down all the details from your favourite Wikipedia pages in case it no longer exists in the UK in a couple months, the ruling is a little more open to interpretation than it sounds at first glance. There&#8217;s still room for a reasonable argument or exception here.<\/p>\n<p>The High Court of Justice ruled that Wikimedia could not legally challenge the OSA in the way that the Wikimedia Foundation, the non-profit that runs Wikipedia, had hoped. However, it specifically called out Wikipedia&#8217;s &#8220;significant value&#8221; to its users. The judge said of the decision, it &#8220;does not give Ofcom and the Secretary of State a green light to implement a regime that would significantly impede Wikipedia\u2019s operations.&#8221;<\/p>\n<p>The Wikimedia Foundation also suggests the ruling could leave Ofcom open to legal action if it <em>didn&#8217;t <\/em>protect Wikipedia and its users&#8217; rights. Not the sort of thing you&#8217;d expect after hearing the court rejected Wikipedia&#8217;s appeal.<\/p>\n<p>&#8220;In order to achieve that outcome, he [the judge] suggested that Ofcom may need to find a particularly flexible interpretation of the rules in question, or that the rules themselves may need amendment in Parliament,&#8221; the Wikimedia Foundation says of the ruling in a <a data-analytics-id=\"inline-link\" href=\"https:\/\/wikimediafoundation.org\/news\/2025\/08\/11\/wikimedia-foundation-challenges-uk-online-safety-act-regulations\/\" target=\"_blank\">post<\/a>.<\/p>\n<p>So, it&#8217;s not a blanket win, but it is a call for common sense, albeit in different words. Though it is ultimately up to Ofcom, the UK&#8217;s regulator in charge of OSA compliance, and Peter Kyle, secretary of state for science, innovation and technology, to take heed. Kyle previously said that <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.pcgamer.com\/software\/browsers\/uk-secretary-of-state-for-science-innovation-and-technology-says-youre-on-the-side-of-extreme-pornographers-and-predators-if-you-want-the-online-safety-act-walked-back\/\" target=\"_blank\">anyone hoping to roll back the OSA is on the side of predators<\/a> and in league with &#8220;extreme pornographers&#8221;, so I&#8217;m not totally convinced he&#8217;s the man for open dialogue about the issues just yet.<\/p>\n<figure class=\"van-image-figure inline-layout\" data-bordeaux-image-check >\n<div class='image-full-width-wrapper'>\n<div class='image-widthsetter' style=\"max-width:1920px;\">\n<p class=\"vanilla-image-block\" style=\"padding-top:56.25%;\"><img loading=\"lazy\" decoding=\"async\" id=\"wQqf5dbFr3YgXTAxEVvfoT\" name=\"age-verification-001\" alt=\"The Yoti homepage on an iPhone.\" src=\"https:\/\/arcader.org\/wp-content\/uploads\/2025\/08\/wikipedia-challenged-the-uks-new-online-safety-act-and-lost-but-may-have-set-a-new-precedent-for-fighting-the-rules-all-the-same.png\" mos=\"\" align=\"middle\" fullscreen=\"\" width=\"1920\" height=\"1080\" attribution=\"\" endorsement=\"\" class=\"\"><\/p>\n<\/div>\n<\/div><figcaption itemprop=\"caption description\" class=\" inline-layout\"><span class=\"credit\" itemprop=\"copyrightHolder\">(Image credit: Yoti, Future)<\/span><\/figcaption><\/figure>\n<p>The Wikimedia Foundation has long argued that it would be devastating to its operations in the UK if it were deemed a Category 1 service. It claims in a <a data-analytics-id=\"inline-link\" href=\"https:\/\/medium.com\/wikimedia-policy\/wikipedias-nonprofit-host-brings-legal-challenge-to-new-online-safety-act-osa-regulations-0f9153102f29\" target=\"_blank\">Medium post<\/a>, the categorisation could potentially lead it to require verification for its millions of self-edited users around the world, or, in turn, allow users to block unverified users and threaten to vandalise pages. Considering Wikipedia is a project run and audited largely by its own users, the implications could be huge.<\/p>\n<p>It seems there is wiggle room for Wikipedia to exist after all. Providing Ofcom and the secretary of state stop trying to bash Wikipedia into something unrecognisable to fit its &#8216;one-size-fits-all&#8217; categories.<\/p>\n<p>&#8220;If the ruling stands, the first categorization decisions from Ofcom are expected this summer,&#8221; the Wikimedia Foundation says in a blog. &#8220;The Foundation will continue to seek solutions to protect Wikipedia and the rights of its users as the OSA continues to be implemented.&#8221;<\/p>\n<p>If you&#8217;re wondering how the rest of the Online Safety Act rollout is going, the UK Government has rejected calls to repeal it off the back of a <a data-analytics-id=\"inline-link\" href=\"https:\/\/petition.parliament.uk\/petitions\/722903\" target=\"_blank\">petition with over 500,000 signatures<\/a> (there&#8217;s a surprise). The bulk of <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.pcgamer.com\/hardware\/nearly-two-thirds-of-brits-surveyed-about-the-uks-new-age-verification-laws-think-the-changes-arent-effective-but-even-more-support-them-being-made-in-the-first-place\/\" target=\"_blank\">Brits asked by YouGov<\/a> think the measures are a good thing, in some capacity, but many think they&#8217;re pretty ineffective. It&#8217;s true, age verification measures are very easily bypassed with a VPN or a picture of Sam Porter&#8217;s face from <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.pcgamer.com\/hardware\/brits-can-get-around-discords-age-verification-thanks-to-death-strandings-photo-mode-bypassing-the-measure-introduced-with-the-uks-online-safety-act-we-tried-it-and-it-works-thanks-kojima\/\" target=\"_blank\">Death Stranding<\/a>. Also, the way user data is expected to move around the web to verify users is fraught with danger\u2014it leaves UK citizen&#8217;s data open to exposure and exploitation. <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.pcgamer.com\/hardware\/the-uks-new-age-verification-is-a-privacy-nightmare-but-it-doesnt-need-to-be\/\" target=\"_blank\">There is a better way to verify a user&#8217;s age<\/a> that values privacy and data security, but we&#8217;re not using it.
