Heyer filed the lawsuit in California on April 11, alleging that she and Roblox were in negotiations to officially license the dance in Roblox; however, Roblox released the emote before negotiations were finalized, and they never came to pass.<\/p>\n<p class=\"has-text-align-none\">Roblox added the dance emote in mid-August, coinciding with <a href=\"https:\/\/www.polygon.com\/gaming\/441531\/roblox-dress-to-impress-charli-xcx-brat-summer-update\">a <em>Dress to Impress<\/em> update that added everything <em>Brat<\/em><\/a><em> <\/em>(Charli XCX\u2019s summer hit album) to the game on Aug. 17. Heyer first posted the \u201cApple\u201d dance on June 15, 2024 and submitted a copyright application for it on Aug. 30. That was after Roblox contacted her to license the dance, which came after Charli XCX\u2019s label contracted <em>Roblox<\/em> to get the artist in <em>Dress to Impress<\/em>. Heyer said she was willing to license the dance on Aug. 12, per the lawsuit. But the dance was released before the negotiations were finalized. Heyer said in the lawsuit that Roblox has \u201crefused to finalize a license agreement\u201d and to compensate Heyer for her dance.<\/p>\n<p class=\"has-text-align-none\">\u201cRoblox moved forward using Kelley&#8217;s IP without a signed agreement,\u201d attorney Miki Anzai said in a statement to Polygon. \u201cKelley is an independent creator who should be compensated fairly for her work and we saw no other option than to file suit to prove that. We remain willing and open to settle and hope to come to a peaceful agreement.\u201d<\/p>\n<p class=\"has-text-align-none\">The <a href=\"https:\/\/www.roblox.com\/catalog\/18946876350\/Charli-xcx-Apple-Dance\">\u201cApple\u201d dance is no longer available for sale on Roblox<\/a> \u2014 it was sold until November 2024. Heyer said in the lawsuit that Roblox sold \u201cin excess of 60,000 units of the Apple Dance emote\u201d and earned \u201can estimated $123,000\u201d in sales. \u201cAs the Apple Dance emote comprises solely of the Apple Dance choreography, completely separate and distinct from the Charli XCX song, the sole \u2018artist\u2019 for purposes of the emote is Ms. Heyer,\u201d lawyers wrote in the complaint.<\/p>\n<p class=\"has-text-align-none\">Heyer\u2019s <a href=\"https:\/\/www.tiktok.com\/@kelley.heyer\/video\/7448063559411584299\">\u201cApple\u201d dance <em>was<\/em> licensed correctly in <em>Fortnite<\/em><\/a>, added in December and sold as an emote. Heyer said Netflix has licensed its usage, too. Heyer is looking to the court to award her Roblox\u2019s profits on the dance, as well as other damages. Epic Games has been sued several times in the past over its usage of popular or viral dances as emotes in the battle royale game; <a href=\"https:\/\/www.polygon.com\/23002010\/fortnite-dance-lawsuit-emote-kyle-hanagami-its-complicated\">five lawsuits were dismissed in 2019<\/a>, including one filed by <em>Fresh Prince of Bel-Air<\/em> actor Alfonso Ribeiro.<\/p>\n<p class=\"has-text-align-none\">One of the more recent lawsuits, filed by choreographer Kyle Hanagami, was dismissed and appealed; the 9th Circuit reversed the dismissal and revived the argument that \u201creducing choreography to \u2018poses\u2019 would be akin to reducing music to just \u2018notes,\u2019\u201d <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/epic-games-resolves-fortnite-dance-moves-copyright-lawsuit-2024-02-13\/\">per the appeals court<\/a>. Both sides agreed to dismiss the lawsuit in 2024.
